Terms of Use

Effective Date: October 3, 2026
Last Updated: October 3, 2026

1. Acceptance of Terms

These Terms of Use constitute a binding agreement between you and Avantis, s.r.o. (“Grammar TOP,” “we,” “us,” or “our”). The following terms and conditions govern your access to and use of the Grammar TOP app for learning English grammar on iOS, iPadOS, macOS and Android, the website at https://www.supergrammar.info, and all related services, features, and content (collectively, the “Services”).

Please read these Terms of Use carefully before using the Services. By downloading, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy available at https://www.supergrammar.info/?page_id=475, which is incorporated into these Terms by reference.

If you do not agree to these Terms of Use or the Privacy Policy, you must not access or use the Services.

2. App Store and Google Play

If you downloaded the app from Apple’s App Store (including on a Mac), your license to use the app is governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms supplement the Standard EULA. If these Terms conflict with the Standard EULA, the Standard EULA prevails for apps downloaded from the App Store.

If you downloaded the app from Google Play, these Terms are the license terms for the app, and Google Play’s terms of service also apply to your download and purchases.

3. Eligibility

The Services are intended for individuals who are at least 13 years of age. If you are under the age of legal majority in your country, you may use the Services only with the involvement of a parent or legal guardian, who must agree to these Terms on your behalf and make or approve any purchase.

4. Changes to Terms

We reserve the right to modify these Terms of Use at any time. When we make changes, we will update the “Last Updated” date at the top of this document and post the new version on this page. For material changes, we will also notify you through an in-app notification.

Changes become effective 30 days after notification. Your continued use of the Services after this period constitutes your acceptance of the modified Terms. A change does not reduce what you receive for a subscription period you have already paid for. We encourage you to review these Terms periodically to stay informed of any updates.

5. No Account; Your Progress

You do not need an account, name, email address or password to use the app. The course content is built into the app and works offline.

Your progress, mistakes, settings and reminder time are stored only on your device. We do not keep a copy of them. If you delete the app, use “Delete all data” in the settings, or move to a new device, your progress cannot be restored.

Earlier versions of Grammar TOP (3.x and earlier) used accounts. The current version does not use those accounts, and progress saved in them is not transferred to it.

6. Free Content, Subscriptions and Payment
6.1 Free Content and Premium

Part of the course is free with no time limit: the first topics of every level, the first lesson of every other topic, and the reference tables. Access to the rest of the course and to some practice features (“Premium”) requires a subscription or a one-time purchase. We may change which parts of the course are free; such a change does not reduce what you receive while you have Premium.

Premium is offered as:

  • An annual subscription, with a 7-day free trial for new subscribers where offered
  • A monthly subscription
  • A lifetime purchase, a one-time payment that is not renewed

Prices are shown in the app before you buy and may differ between countries.

6.2 Free Trial

When you start a free trial:

  • You will have access to all Premium features for 7 days at no charge
  • Your subscription will automatically convert to a paid annual subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends
  • The app shows the date of the first charge before you start the trial
  • A free trial is available once per store account, as determined by the store’s rules
6.3 Payment Processing

All purchases are made through Apple’s App Store or Google Play and are processed by Apple or Google. By purchasing Premium, you agree to the terms and conditions of the store you buy from. We do not receive or store your card or bank details.

6.4 Subscription Fees and Billing
  • Subscription fees are charged to your App Store or Google Play account in advance on a recurring basis (monthly or annually, depending on your selected plan)
  • Your subscription will automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period
  • Taxes are applied by the store according to its rules and the law of your country
  • Prices are subject to change; the store will notify you of a price increase for your subscription in advance and, where its rules or the law require, ask for your consent
6.5 Right of Withdrawal and Refund Policy

Under European Union consumer protection law, you may have the right to withdraw from a contract for digital content within 14 days. Because you buy Premium from Apple or Google, this right, and any refund, is handled by the store under its own policies. When you buy, the store may ask you to confirm that you request immediate access to Premium and that you therefore lose your right of withdrawal.

We cannot issue refunds for purchases made through the App Store or Google Play ourselves. To request a refund, use reportaproblem.apple.com for App Store purchases or your Google Play order history for Google Play purchases.

Cancellation During Free Trial:
You may cancel your subscription at any time during the 7-day free trial period without being charged, as long as you cancel at least 24 hours before the trial ends.

Cancellation After Trial:
Once your paid subscription begins, you may cancel it at any time. Except where the store’s refund policy or applicable law provides otherwise, you will not receive a refund for fees already paid, and your subscription will remain active until the end of the current billing period.

6.6 Subscription Cancellation

You cancel your subscription through the store, not in the app:

  • On iPhone, iPad and Mac: Settings > your name > Subscriptions
  • On Android: Google Play > Payments & subscriptions

The app links to these pages from its Profile tab.

Deleting the app does not cancel your subscription.

Upon cancellation:

  • Your access to Premium will continue until the end of your current billing period
  • You will not be charged for subsequent billing periods
6.7 Failed Payments

If a renewal payment fails, the store may try to process it again and may give you a grace period under its rules. If payment is not successfully processed, your access to Premium may end until it is.

6.8 Restoring Purchases and Earlier Purchases

Premium is linked to your App Store or Google Play account, not to your device. To get Premium on a new device or after reinstalling the app, sign in to the same store account and tap “Restore purchases” in the app. A purchase made on the App Store unlocks Premium on iPhone, iPad and Mac but not on Android, and a purchase made on Google Play does not unlock Premium on Apple devices.

Subscriptions and lifetime purchases bought in earlier versions of Grammar TOP continue to give Premium in the current version for as long as they are active (a lifetime purchase, for as long as we offer the app). If we stop selling a plan, an active subscription to it continues until it is cancelled or ended by the store, and a lifetime purchase remains valid.

“Lifetime” means for as long as we offer the app, not for your lifetime.

7. Use of Services and Acceptable Use
7.1 License Grant

Subject to your compliance with these Terms (and, for apps downloaded from the App Store, the Standard EULA), we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use, on devices you own or control as permitted by the store you downloaded the app from.

7.2 Permitted Use

You may use the Services to:

  • Learn English grammar with the course’s rules, lessons and exercises
  • Review your mistakes and practice
  • Use the reference tables
  • Report mistakes in the course content and send us feedback
7.3 Prohibited Activities

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
  • Use the Services in any manner that could damage, disable, overburden, or impair our servers or networks
  • Attempt to gain unauthorized access to any part of the Services or our computer systems
  • Use any automated system, including robots, spiders, or scrapers, to access the Services or extract the course content
  • Reverse engineer, decompile, or disassemble any part of the Services, except where applicable law expressly permits it
  • Remove, modify, or obscure any copyright, trademark, or other proprietary rights notices
  • Use the Services to transmit any viruses, malware, or other malicious code
  • Engage in any activity that interferes with or disrupts the Services
  • Use the Services for any commercial purpose without our prior written consent
  • Attempt to bypass any security features, access restrictions, or the store’s purchase verification
  • Send us error reports or feedback containing illegal, offensive, or infringing content
8. Intellectual Property, Error Reports and Feedback
8.1 Error Reports and Feedback

When you report a mistake in a lesson or an exercise, or send us feedback or suggestions by email, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, store, reproduce, and process them for the purpose of correcting and improving the course and the Services, without naming you. You do not have to send error reports or feedback.

Please do not include personal information in an error report. What we receive with an error report is described in the Privacy Policy. We read the reports we receive, but we do not undertake to make every suggested change or to reply to every report.

8.2 Our Intellectual Property

The Services, including all software, text, course content (rules, explanations, exercises, examples and reference tables), images, illustrations, graphics, user interfaces, visual interfaces, trademarks, logos, sounds, artwork, and computer code (collectively, “Grammar TOP Content”) are owned by Avantis, s.r.o. or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Services or Grammar TOP Content
  • Create derivative works based on the Services or Grammar TOP Content, including by copying course content into other apps, websites or learning materials
  • Use any trademarks, logos, or branding without our prior written permission
8.3 Limited Exceptions

You may:

  • Share screenshots or descriptions of the Services for the purpose of promoting or discussing Grammar TOP
  • Use the Services as permitted by these Terms
9. Educational Content

Grammar TOP is a self-study course. We work to keep the rules, explanations and exercises accurate and clear, but the course content may contain mistakes, which we correct as we find them. You are responsible for your own learning and for how you use what you learn.

The Services do not award certificates or qualifications and are not affiliated with or endorsed by any examination or exam board. We do not guarantee any particular result, such as reaching a level, passing an exam, or a grade or score.

Example sentences are read aloud by the speech engine built into your device, which is provided by the device’s operating system.

10. Third-Party Services and Links
10.1 Third-Party Services

The Services rely on third-party services, including Apple’s App Store and Google Play for downloads and payments, and service providers for subscription management and usage analytics described in the Privacy Policy. Your use of the App Store and Google Play is subject to their respective terms and privacy policies.

10.2 Third-Party Links

The Services may contain links to third-party websites or resources. We do not endorse and are not responsible for:

  • The availability, accuracy, or content of third-party websites
  • Any products, services, or content available through third-party sites
  • The privacy practices of third-party sites

Your interactions with third-party websites are solely between you and the third party, and you access them at your own risk.

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information are governed by our Privacy Policy, available at https://www.supergrammar.info/?page_id=475.

Key privacy points:

  • You do not need an account, and your progress is stored only on your device
  • Data sent by the app travels over encrypted connections
  • You can turn off usage analytics in the app at any time
  • The app shows no ads
  • We comply with GDPR and other applicable data protection laws
  • We never sell your personal information to third parties
  • You have rights to access, rectify, erase, and port your data
12. Service Availability and Modifications
12.1 Service Availability

We strive to provide reliable Services. However, we do not guarantee that:

  • The Services will always be available, uninterrupted, or error-free
  • All features will function perfectly at all times
  • The Services will meet all your requirements or expectations

We may need to suspend or restrict access to parts of the Services, such as purchases or the restoring of purchases, for maintenance, updates, or unforeseen circumstances.

12.2 Service Modifications

We reserve the right to:

  • Add, rewrite, reorder, or remove lessons, exercises and other course content
  • Modify, update, or discontinue features or functionality of the Services
  • Change the Services, including which content is free

While you have Premium, you have access to the full course as it is at that time. If we decide to stop offering the app, we will tell you in the app or on our website in advance where possible. The course content built into the app will keep working on devices where it is installed, but we cannot promise that it will work with future operating systems.

12.3 Updates

We may release updates, patches, or new versions of the Services. You may need to install updates to continue using the Services effectively.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICES
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICES ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS

We do not warrant that:

  • The Services will meet your specific requirements
  • The course content will always be free of mistakes
  • You will reach any particular level or result
  • The Services will be compatible with all devices or operating systems

You acknowledge that:

  • Your use of the Services is at your own risk
  • The Services are an educational aid and not a substitute for a teacher, an official exam preparation programme, or professional advice

Nothing in these Terms shall exclude or limit our liability for matters that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence or fraud. If you are a consumer, nothing in these Terms affects your statutory rights, including the legal guarantee that digital content conforms to the contract.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

IN NO EVENT SHALL AVANTIS, S.R.O., ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE, INCLUDING LOSS OF LEARNING PROGRESS STORED ON YOUR DEVICE
  • LOSS OF BUSINESS OR ANTICIPATED SAVINGS
  • DAMAGES ARISING FROM YOUR INABILITY TO ACCESS OR USE THE SERVICES
  • DAMAGES ARISING FROM ERRORS, INACCURACIES, OR OMISSIONS IN THE SERVICES OR THE COURSE CONTENT

WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR GRAMMAR TOP PREMIUM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR €100, WHICHEVER IS GREATER.

Nothing in these Terms shall exclude or limit our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under applicable law
15. Indemnification

You agree to defend, indemnify, and hold harmless Avantis, s.r.o., and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or relating to:

  • Your misuse of the Services
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Any content you submit to the Services, including error reports and feedback
  • Your violation of any third-party rights, including intellectual property, privacy, or publicity rights

This indemnification obligation survives the termination of these Terms and your use of the Services, and applies to the extent permitted by applicable consumer protection law.

16. Termination
16.1 Termination by You

You may stop using the Services at any time by deleting the app. To stop future payments, you must also cancel your subscription in the store as described in Section 6.6.

16.2 Termination by Us

We reserve the right to suspend or terminate your license to use the Services, to the extent permitted by the store’s rules and applicable law, if:

  • You violate these Terms or, for apps downloaded from the App Store, the Standard EULA
  • You violate any applicable laws or regulations
  • You engage in fraudulent, illegal, or harmful activities, including copying and distributing the course content
  • You attempt unauthorized access to the Services or to bypass purchase verification
  • You use the Services in a manner that could harm us, other users, or third parties
16.3 Effect of Termination

Upon termination:

  • Your right to access and use the Services will cease
  • Termination does not cancel a subscription bought through the store; you must cancel it in the store, and any refund is handled by the store under its policies
  • All provisions of these Terms that by their nature should survive termination shall remain in effect, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability
17. Governing Law and Dispute Resolution
17.1 Governing Law

These Terms and any disputes arising from or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions. For apps downloaded from the App Store, the law governing the license itself is set by the Standard EULA (Section 2).

17.2 Jurisdiction and Venue

Any legal action, suit, or proceeding arising out of or relating to these Terms or the Services shall be instituted exclusively in the courts located in Bratislava, Slovak Republic. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts, except as provided in Section 17.3.

17.3 Consumer Rights

If you are a consumer residing in the European Union, nothing in these Terms affects your statutory rights as a consumer under applicable EU law, including your right to bring proceedings in the courts of your country of residence. If you are a consumer residing elsewhere, the choice of law in Section 17.1 does not deprive you of the protection of the mandatory consumer protection rules of your country of residence.

17.4 Dispute Resolution Process

Before initiating any legal proceedings, we encourage you to contact us at avantis.apps@gmail.com to attempt to resolve any disputes informally. We will work in good faith to resolve disputes amicably.

18. General Provisions
18.1 Entire Agreement

These Terms, together with our Privacy Policy and, for apps downloaded from the App Store, the Standard EULA, constitute the entire agreement between you and Avantis, s.r.o. regarding the Services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, including earlier versions of these Terms.

18.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Avantis, s.r.o.

18.4 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations under these Terms without our prior written consent. We may assign, transfer, or delegate these Terms and our rights and obligations, provided that this does not reduce your rights under these Terms. Any attempted assignment in violation of this section is void.

18.5 No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person or entity other than you and Avantis, s.r.o.

18.6 Language

These Terms are drafted in English. If these Terms are translated into any other language, the English version shall prevail in case of any conflict or inconsistency.

18.7 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

18.8 Notices

Because the app has no accounts, we will give you notices through in-app notifications or by posting them on our website, and, if you have written to us, we may also reply to your email address. Notices to us should be sent to:

Avantis, s.r.o.
Pekná cesta 19
831 52 Bratislava
Slovak Republic
Email: avantis.apps@gmail.com

Notices are deemed received when sent to the provided email address or three (3) business days after being sent by postal mail.

18.9 Export Control

You agree to comply with all applicable export and import control laws and regulations in your use of the Services. You represent that you are not located in a country subject to a European Union or United States government embargo and are not listed on any government list of prohibited or restricted parties.

18.10 Electronic Communications

By using the Services, you consent to receive electronic communications from us, including in-app messages, notifications, and replies to emails you send us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

19. California Residents

If you are a California resident, under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 to resolve complaints regarding the Services.

20. Supervisory Authority

If you are located in the European Union and have concerns about our data processing practices or wish to lodge a complaint, you have the right to contact your local data protection authority, in Slovakia the Office for Personal Data Protection of the Slovak Republic.
